Why You Should Make a Will

What is a Will?

A Will is a legal document through which an individual (the testator/ testatrix ) records how his/her assets and properties—both movable and immovable—should be distributed after his/ her lifetime. It reflects the wishes of the testator/ testatrix and provides certainty for family members and beneficiaries.

Legal Requirements for a Valid Will

Under Indian law, the following are essential for a valid Will:

  • The testator must be of sound mind. 
  • The testator must have attained the age of majority.

Testator/Testatrix should obtain a medical certificate from the consulting physician and executed preferably on the same day in presence of 2 witnesses. Witnesses should be much younger and ready and willing to file Affidavits in Court.

Probate

To prove genuineness of the Will, the executor after passing away of the testator must file a petition alongwith Original Will in the District Court. The District Court after ascertaining and verifying details mentioned therein may grant Probate on compliance of executing an administration Bond, Attesting Witness Affidavits, etc.
